Autoclose: 1 -->\n<div style='height:40px' class='hr hr-invisible  '><span class='hr-inner ' ><span class='hr-inner-style'><\/span><\/span><\/div>\n<div class=\"flex_column av_one_full  no_margin flex_column_div av-zero-column-padding first  \" style='border-radius:0px; '><section class=\"av_textblock_section \"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock  '   itemprop=\"text\" ><ul>\n<li>Ein Testament muss in Anwesenheit eines <strong>Notars unterschrieben<\/strong> werden.<\/li>\n<li>Die Funktion des Notars besteht darin, dass der Erblasser wirklich derjenige ist, der er vorgibt zu sein und dass der letzte Wille aus freiem Willen erstellt wird und dass der Erblasser im Vollbesitz seiner geistigen Kr\u00e4fte ist.<\/li>\n<li>Der Erblasser muss selbst bei der <strong>Unterzeichnung<\/strong> des Testaments anwesend sein, es gibt also keine M\u00f6glichkeit, eine Vollmacht f\u00fcr die Unterzeichnung in Vertretung des Erblassers zu erstellen.<\/li>\n<li>Wenn der Erblasser seine W\u00fcnsche in einer Sprache \u00e4u\u00dfert, die der Notar nicht versteht, muss der Erblasser einen \u00dcbersetzer\/Dolmetscher engagieren.<\/li>\n<li>In einem spanischen Testament, das von einem ausl\u00e4ndischen B\u00fcrger verfasst wird, muss der Erblasser im <strong>gleichen Dokument<\/strong> seine W\u00fcnsche in Spanisch und in seiner <strong>Muttersprache<\/strong> zum Ausdruck bringen, z.b. Norwegisch.<\/li>\n<li>Der Notar beh\u00e4lt das <strong>Original<\/strong> des Testaments und schickt eine Bekanntmachung an das spanische Testamentarchiv in Madrid, das \u201c<strong>Registro Central de Ultima Voluntad<\/strong>\u201d. Der Erblasser erh\u00e4lt eine beglaubigte Kopie.<\/li>\n<li>Nach norwegischem Erbrecht muss ein g\u00fcltiges spanisches Testament in Norwegen G\u00fcltigkeit haben. Es ist wichtig, dass das norwegische Testament nicht dem Inhalt des spanischen Testaments widerspricht. Juristisch ist die Erstellung eines spanischen Testaments daher nicht zwingend erforderlich.<\/li>\n<li>Dennoch kann ein spanisches Testament den Eigent\u00fcmerwechsel in Spanien erleichtern, beschleunigen und <strong>\u00f6konomisch<\/strong> sinnvoll sein. Das norwegische Testament muss \u00fcbersetzt und gerichtlich <strong>anerkannt<\/strong> sein.<\/li>\n<li>Eine gro\u00dfe Zahl an <strong>Vorbedingungen<\/strong> muss dokumentiert sein, dazu geh\u00f6ren die G\u00fcltigkeit des Testaments, die <strong>juristische F\u00e4higkeit<\/strong> des Erblassers ein Testament zu erstellen, die \u00dcbersetzung von Dokumenten, die beglaubigt und gerichtlich anerkannt sein m\u00fcssen. In der Praxis f\u00fchrt dies dazu, dass Erbf\u00e4lle mit einem spanischen Testament ein paar Monate dauern, w\u00e4hrend es sich mit einem ausschlie\u00dflich nach norwegischem Recht verfassten Testament Jahre hinziehen kann. Das Bankkonto des Erblassers wird &#8222;eingefroren&#8220;, bis der <strong>Eigentumswechsel vollzogen<\/strong> ist.
